Detailed Description Development, implementation and maintenance of an integrated cash register system, including equipment delivery, installation, servicing and cashless payment processing

1. The subject of the order is the development, implementation, and maintenance of the Integrated Cash Register System (ICS) including the delivery of devices, their installation, servicing, cashless payment processing, and training for participants indicated by the Ordering Party.
2. The Ordering Party requires that the Contractor perform the subject of the order in accordance with the Ordering Party's requirements indicated in the Description of the subject of the order constituting Appendix No. 1 to the SWZ, No. 1 to the contract.
3. The detailed description, scope, requirements, and method of performing the subject of the order are specified in the Draft provisions of the contract constituting Appendix No. 2 to the SWZ and the annexes to the Draft provisions of the contract.
4. In all provisions of the SWZ and its annexes that refer to standards, technical assessments, technical specifications, and technical reference systems, in accordance with Art. 101, sec. 4 of the Public Procurement Law, the Contracting Authority allows the use of solutions equivalent to those described in standards, technical assessments, technical specifications, and technical reference systems indicated in the Technical Specifications and annexes, if they allow for the achievement of features or parameters not worse than those referred to in the Technical Specifications and annexes. In the case of using equivalent solutions, the Contractor is obliged to demonstrate in writing the equivalence of the offered technical parameters in relation to the subject of the contract. The Contractor shall prove in the offer, in particular using the evidence referred to in Art. 104-107 of the Public Procurement Law, that the proposed solutions meet the requirements specified in the Description of the Subject of the Contract to an equivalent extent. 5. The description of the subject of the contract in this procedure was prepared in a manner aimed at obtaining by the Contracting Authority goods and services whose environmental impact during their life cycle is lower compared to goods and services with identical purposes that would otherwise be procured (green public procurement). 6. The Contracting Authority requests the submission of the evidence referred to in Sec. 4 (if applicable) and Chapter VIII, section 1, item 3) of the ToR. If the Contractor fails to submit the evidence in question or the evidence submitted is incomplete, the Ordering Party, in accordance with the provisions of Art. 107, section 2 of the Public Procurement Act, will request the Contractor to submit or supplement the evidence in question in the form of the Technical Specification of the Integrated Cash Register System constituting Annex No. 3 to the ToR, 1.1 to the Draft Contract Provisions, and will request the submission or supplementation of the evidence in question referred to in section 4 (if applicable). 7. In this procedure, the Ordering Party does not envisage requirements in the scope of employment on the basis of an employment relationship in the circumstances referred to in Art. 95 of the Public Procurement Act.
